ShakeSERP Terms of Service
Version: 2026-09-30 · Provider: Area81 Solutions AB (org.nr 559099-5550), Sweden ("Area81", "we")
1. The Service
ShakeSERP is a content and search-visibility platform for agencies and for businesses purchasing directly ("Customer", "you"). Where the Customer is an agency, "end client" refers to the businesses it registers; where the Customer purchases directly, the Customer is its own end client and the agency-related provisions apply to it directly. For each end client the Customer registers, the Service: (a) sends short monthly expert interviews by email via passwordless links; (b) generates draft articles from the interview answers using third-party AI models; (c) publishes articles to the end client's WordPress site via a connector plugin the end client installs; (d) measures search-engine positions, aggregate website traffic, Google Search Console data (where the Customer connects it) and citations by AI answer engines; (e) provides progress reports and a billing/credit ledger. In addition, depending on what the Customer uses: short Small Talk questions, audio versions, podcasts and videos (with stock voices or an employee's own voice), publishing to social channels and email tools the Customer connects, keyword data (search volume, cost per click, difficulty and SERP features), and analysis of why an article isn't ranking with proposed improvements.
2. Account, acceptance and versions
Creating an account requires explicit acceptance of these Terms; the accepted version and timestamp are recorded. If the Terms change materially, continued use requires acceptance of the new version at next login. Only authorised representatives of the Customer may accept.
3. Customer responsibilities
The Customer (a) has obtained the right to act for each end client it registers, including sending interviews to the named contact person, publishing to their website, and connecting their Google Search Console; (b) is responsible for the accuracy of end-client information; (c) will present the End-Client Privacy Notice (see Privacy Policy §8) to each end client before their first interview; (d) will not use the Service to publish unlawful, misleading or infringing content; (e) is fully responsible for everything the Customer, its end clients and anyone using the Service through the Customer's account enters, approves, publishes or lets publish automatically — texts, answers, images, files, voices, trademarks, offers and claims; (f) holds every right, permission and consent needed for the material entered (copyright, trademarks, personal data, images of people, voices); (g) complies with the law that applies to the Customer's own business and marketing, including marketing law, copyright law, the GDPR and the EU AI Act.
3a. Prohibited use
The Service must not be used to: (1) create, clone or imitate another person's voice, or record anyone other than oneself; (2) impersonate another person or business; (3) publish misleading advertising, fake reviews, false claims about competitors or invented facts about the company; (4) publish offensive, hateful, threatening, discriminatory or unlawful content; (5) infringe anyone's copyright, trademark or other rights; (6) process personal data about others without a legal basis, or enter sensitive personal data (e.g. health, religion, ethnicity) or data about offences; (7) send unsolicited advertising (spam); (8) attempt to circumvent the Service's security, consent checks or limits, or access anyone else's data; (9) create content presented as coming from an authority, person or organisation that does not stand behind it.
3b. Customer warranties and liability towards Area81
The Customer warrants that its use of the Service complies with sections 3 and 3a. The Customer indemnifies Area81 — compensates Area81 for claims, damages, administrative fines to the extent the law allows, and reasonable legal costs — where a claim by a third party or an authority is based on content, material, voices or claims that the Customer, its end clients or users entered, approved or let publish, or on use in breach of these terms. Area81 notifies the Customer of such a claim without delay and cooperates in the defence.
3c. Suspension and removal
Area81 may, without prior notice, remove or unpublish content, delete a voice, disable a feature or temporarily suspend an account where there is reason to believe these terms are being breached, where an authority or court requests it, or where it is needed to protect a person, the Service or other customers. The Customer is informed of the action and the reason as soon as possible. Such actions create no liability for Area81 and do not release the Customer from payment.
4. AI-generated content
Articles are AI-generated drafts built on the expert's own answers. The Customer (or its end client) reviews and is responsible for all published content. We do not warrant rankings, citations by AI engines, or traffic outcomes; search results depend on third parties we do not control.
Automation is the Customer's choice. By default every article, and every proposed change to a published article, waits for the Customer's approval. If the Customer chooses automatic publishing or automatic improvements in the service's settings, content is published without prior review; the Customer is then responsible for it in the same way as for reviewed content. Automatic changes are announced in the portal and can be undone for 14 days.
No training. We do not use the Customer's or end clients' content to train AI models, and our AI providers are engaged on terms or with settings under which they do not either (see DPA Annex B).
4a. Answers and quotes
Interview and Small Talk answers are used as source material for the end client's own content and are rephrased. An answer is not quoted verbatim with attribution unless the person who answered, or the Customer, has approved that specific quote. Figures from answers are presented as the company's own experience. Answers are never used for any other client.
4b. Own voices
- Only your own voice. A voice is created only by the signed-in person themselves. The person accepts a consent text bearing their name and also says a consent sentence with a one-time code at the start of the recording. The recording is checked automatically before the voice is created — if the name and code aren't heard, no voice is created. The consent, the text, the code and what was said are kept as evidence.
- Voluntary. The Customer ensures that an employee records their voice voluntarily, and that anyone who declines, or later deletes their voice, suffers no negative consequence.
- Only for the Customer. The voice is used only for the Customer's own end client's content: reading articles, podcasts and videos aloud. It must not be used to say anything the person doesn't stand behind; in podcast conversations the script is approved before anything is recorded.
- Deletion. The voice can be deleted at any time by the person or an owner, and is deleted automatically when the Customer's account ends; it is then deleted at our provider too. Area81 may delete a voice on suspicion of misuse. Content already published is not changed.
- Misuse. Cloning or attempting to clone anyone else's voice is prohibited (section 3a) and leads to the voice being deleted and the account possibly being suspended.
4c. AI labelling
Content in the Service is created with AI. Audio and podcast episodes read by AI voices are labelled as AI-generated in the Service and in the podcast feed, and the Customer must not remove or hide that label. The Customer is responsible for making sure what it publishes meets the labelling and information requirements that apply to the Customer, including under the EU AI Act (Article 50).
4d. Search data
Search volume, cost per click, difficulty (NS%), SERP features and positions come from third parties (including DataForSEO, SerpApi and Google) and are estimates provided as is.
5. Credits, fees and billing
Service consumption is measured in credits (one credit = one interview→article cycle). Credits are granted via Stripe subscription payments or manual invoicing as agreed. The platform may run additional cycles ("boosters") at no extra credit cost at our discretion; these never create additional charges. All fees are stated excluding VAT; VAT is added at the applicable rate at payment (reverse charge applies for EU business customers with a valid VAT number). Unused credits from a terminated subscription expire [30] days after termination unless otherwise agreed. Fee changes are announced at least [30] days in advance and never apply retroactively within a fixed term (§5a).
5a. Subscription plans and fixed terms (bindningstid)
The Service is offered on a rolling monthly plan or on fixed terms of 6 or 12 months at a reduced monthly fee. On a fixed-term plan, payment remains monthly but the agreement is binding for the chosen term: the Customer may request cancellation at any time, and it takes effect at the end of the fixed term; monthly fees remain payable until then. On the rolling plan, cancellation takes effect at the end of the current billing period. The chosen term, its start date and its end date are shown in the Customer's portal at all times. For manually invoiced customers, the agreed term and fee are recorded at provisioning and any extension is agreed in writing (email suffices) before being registered on the account. After a fixed term ends without a new agreed term, the subscription continues as rolling monthly at the then-current rolling rate unless terminated.
6. Third-party services
The Service relies on sub-processors and third-party APIs. The complete, current list is in the Data Processing Agreement, Annex B (sub-processors) and Annex C (other recipients), and at shakeserp.com/security. Their availability may affect the Service; we are not liable for third-party outages beyond re-performing affected work.
7. Intellectual property
Generated articles belong to the Customer's end client upon publication. The interview answers remain the end client's information; we process them only to provide the Service (including a per-client retrieval memory used solely for that same client — see Privacy Policy §5). The platform, its software and models of operation remain Area81's property. We may use aggregated, anonymised statistics that can never be traced to a client to improve the Service and, only with prior written consent, in benchmarks.
8. Data protection
Processing of personal data is governed by the Privacy Policy and, where we act as processor for the Customer, the Data Processing Agreement (DPA), both incorporated into these Terms.
9. Term and termination
Subscriptions run in 6-month periods unless otherwise agreed. Either party may terminate for material breach uncured within 30 days of written notice. Upon termination we delete or return end-client personal data per the DPA; the Customer may export reports before the effective date.
10. Liability
Except for intent or gross negligence, total liability is capped at the fees paid in the 12 months preceding the claim; neither party is liable for indirect damages (lost profits, lost data restorable from backups, goodwill). Area81 is not liable for content that the Customer, its end clients or users enter, approve or let publish — manually or automatically — or for decisions made on the basis of the Service's content, analyses or search data. Nothing limits liability that cannot be limited under mandatory Swedish law.
11. Governing law and disputes
Swedish law governs. Disputes are settled by Swedish courts with Stockholms tingsrätt as first instance, unless mandatory law provides otherwise.
